What Enhancer ("the Service") is operated by Vintify AI ("we", "us", "our"). By creating an account or using the Service you ("you", "user") enter into a binding agreement with Vintify AI.
By accessing, registering for, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction and, if acting on behalf of an organisation, that you have authority to bind it.
What Enhancer lets users upload product photos and receive AI-enhanced versions intended for online marketplaces. Daily enhancement limits depend on the plan you subscribe to.
You must not misuse the Service. In particular you must not: (a) use it unlawfully or to infringe third-party rights; (b) submit fraudulent, spam, hateful, deceptive or illegal content; (c) upload images you do not have the right to use; (d) attempt to interfere with the Service's security, probe, scan, scrape, reverse engineer, or introduce malware; (e) resell or redistribute the Service or circumvent technical limits.
You are responsible for the images and prompts you submit and for verifying that outputs are suitable for your use. Outputs may contain inaccuracies and should not be relied upon as professional advice. We may filter, moderate, refuse, or remove content that violates these Terms, and may suspend accounts for repeated infringement.
We retain all rights in the Service, including software, models, branding and documentation. You retain rights in the content you upload, and grant us a limited licence to host and process it solely to provide the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically until cancelled. Cancellations take effect at the end of the current billing period; you keep access until then.
We do not guarantee that the Service will be uninterrupted, error-free, or always available. We disclaim all implied warranties to the fullest extent permitted by law.
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may stop using the Service at any time.
To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data, or goodwill. Nothing limits liability that cannot be excluded by law.
You agree to indemnify Vintify AI from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
We may update these Terms. Continued use after changes are posted constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which Vintify AI is established, without regard to conflict of laws principles.
